This is one of the most common questions homeowners ask when they're struggling, and the short answer is yes. As long as the home is still in your name, you can usually sell it, even if you're months behind, you've received a Notice of Default or foreclosure has already started.
What changes is how the sale happens.
Two ways to sell when you're behind
1. You still have equity. If your home is worth more than you owe, you can usually sell normally, pay off the loan (including the missed payments) at closing and keep what's left.
2. You owe more than the home is worth. If the sale price won't cover the loan plus the costs of selling, the lender has to approve a lower payoff. That's a short sale. It's still a sale, just with extra steps and a negotiation.
What if foreclosure has already started?
A Notice of Default or foreclosure letter doesn't mean you can't sell. It does mean time is shorter and decisions need to be made sooner. Many short sales close after foreclosure has started, but it becomes a race against the clock.
Will the bank let me sell?
Usually, yes. Foreclosure is expensive for lenders, with legal costs, vacant homes and property damage. A well-prepared short sale often makes more financial sense for them. Approval isn't guaranteed, which is why the file has to be done right.
